TERMS AND CONDITIONS

AGREEMENT TO TERMS

 

These terms constitute a legally binding agreement made between you and Cel Mek, Inc. (referred to hereafter as “Cellular Mekanix”, “we”, “us”, or “our”). By leaving your device in our care for service, or repair you agree that you are the rightful owner of the device and that you have read and understand these terms of service in full. IF YOU DO NOT AGREE TO THE TERMS AND CONDITIONS PROVIDED HERE WE WILL NOT BE ABLE TO SERVICE YOUR DEVICE.

 

We reserve the to update or change these Terms and Conditions at any time without prior notification. Changes to these terms and conditions will be accompanied by a new date at the top of the page. It is your responsibility to read and understand these terms and conditions each time you visit Cellular Mekanix for service or repair of your device. 

 

WE RESERVE THE RIGHT TO REFUSE BUSINESS TO ANYONE FOR ANY REASON. If we believe that you have misrepresented yourself in any way that could be harmful to Cellular Mekanix, our customers, or the public in general we reserve the right to terminate our business with you and return your device in whatever state it may be in.


 

REPAIRS

 

  1. Device Manufacturer’s Warranty

If your device is still within your manufacturer’s warranty period any repair that we provide may void the warranty. Your warranty may already be voided due to any physical damage on the device, but it is your responsibility to consult with your manufacturer before leaving your device for repair. We are not legally or financially responsible for a warranty voided by any repairs that you have requested us to perform.

 

  1. Repair Time Estimate

We do our best to estimate how long it will take to repair your device, but factors outside of our control may influence that estimate. Any estimate for shipping or repair time should be considered nothing more than an estimate. These time estimates should not be considered binding and we are not responsible legally or financially for any loss resulting resulting from repairs that take longer than estimated.

 

  1. Cosmetic Damage

Most devices are difficult to repair without leaving any trace behind. We do our best to maintain the cosmetic quality of your device, but it is often not possible to repair a device without leaving signs of tool marks, adhesive residue, etc. We are not legally or financially responsible for any loss resulting from cosmetic signs of repair.

 

  1. Abandoned Devices

Any working or non-working device left at Cellular Mekanix more than 30 days after service has been completed may be recycled whether contact is able to be made with the customer or not.

 

  1. Water Resistant Devices

Many devices are released from the manufacturer with an Ingress Protection (IP) rating or some other indication regarding water resistance. The tests performed on these devices are limited in scope, and should not be considered a reliable guarantee against water intrusion after a device has been damaged and/or repaired. We are not legally or financially responsible for any loss resulting from water ingress on any device that we have repaired.

 

  1. Repairing Water Damaged Devices

Water intrusion can damage every part of a device. As a result, repairing water damaged devices is a complicated and time intensive task. Most devices will take a minimum of 24 to 48 hours to attempt to repair. Due to the construction of the main logic board, iPhone X, iPhone Xs, and iPhone Xs Max take a minimum of 72 hours to treat for water damage. As stated previously these are time estimates only and should not be considered to be binding deadlines. In the intervening period of time there is no way for us to know if the device is repairable or not.

 

Attempting to clean and repair a water damaged device may result in some or all functionality present at the time of check-in to cease, and the device to be rendered less functional than when it came in. We are not legally or financially responsible for loss of functionality of water damaged devices that are being cleaned and/or repaired.

 

PRIVACY POLICY

 

  1. What information do we collect?

We collect personal information to contact you about the status of your repair. We also collect your device passcode for testing and warranty purposes. 

 

We collect payment information, such as credit card numbers, and security codes for the purpose of processing your payment for our services. Our payment processor in most cases is Square, and you should review their privacy policy for more information.

 

In some cases we may ask you for passwords to accounts such as iCloud, Gmail, etc. In these cases it is because you have asked us to perform a specific service for you that we could not otherwise perform. 

 

We may perform a complete backup of your device data. Most often this is done because you have asked for a specific service that requires your device to be backed up, such as a factory reset and restore. In some rare cases this may be because of unforeseen complications that may otherwise result in a complete loss of data (i.e. a phone that comes in for a screen repair that has severe water damage that you were not aware of). 

 

  1. Will your information be shared with anyone?

  • We do not sell or otherwise share your information with advertisers. 

  • In some cases we may share your information with third parties to fulfill our obligations in relation to the services that you have asked us to perform.

  • We may share your information when required to do so by law, (i.e. under court order or subpoena) 

  • We may disclose your information when we feel that doing so would prevent harm to us, or the public. This may include evidence of illegal activity.

 

  1. How long do we retain your information?

We keep your information for as long as is necessary to fulfill our obligation to you for the services that you have requested. Data such as contact information is maintained for your future business with us. Unless you are otherwise notified we do not maintain your payment information after your payment has been made. Your passcode, and account information may be stored unless we are otherwise asked not to store such information. Device backups are stored on our local computers, and are deleted as we need to make room for more backups unless you ask for them to be deleted. 

 

DISPUTE RESOLUTION

 

Any legal action performed by either you or us (referred to here as the “parties”) will be in the state and federal courts located in the United States of America, Oregon. Parties waive any defense related to jurisdiction and consent for all legal proceeding to commence in the state of Oregon. In no case shall either party bring legal action against the other after one year has passed since the original service was performed.

 

MISCELLANEOUS

 

Our failure to enforce any provision of these Terms and Conditions does not constitute a waiver of the terms in full. If any provision in this agreement is determined to not be legally enforceable it does not negate the document as a whole, but invalidates that specific provision only. We are not responsible for any loss or damage resulting from delays or other factors that are out of our control. By signing the summary of these terms located at the front desk you agree that you have read and understand this document in full. If you are unable to sign in person for any reason, but you have been notified of this document continuing to utilize our services constitutes an agreement that you have read and understand these terms and conditions.

Warranty Disclaimer for Repair Services

 

Thank you for trusting Cellular Mekanix with your device repair.

 

This limited warranty applies to the specific parts repaired or replaced at the time of service. 

 

What does this limited warranty cover?

This limited warranty covers parts and labor serviced at the time of repair for devices that remain in the same physical condition as the time of last service. 

 

During the life of the device Cellular Mekanix will repair or replace, at no charge, previously repaired parts that prove defective due to issues originating with the manufacture or installation of said parts.

 

What we will do to correct problems?

We will first attempt to fix the part already installed in your device. After we have exhausted the option of repairing the part, and have determined that the part is indeed at fault we will replace it free of charge.

 

How long does the coverage last?

Coverage for the repair lasts for the life of the device as long as the part is still in the same physical condition as at the time of repair.

 

What does the limited warranty not cover?

The warranty does not cover parts that show signs of physical damage, including but not limited to: cracks, bends, dents, burns, scratches, and intrusion from dust or water.

 

The warranty does not cover used parts (whether supplied by you or us), but may cover some of the labor involved in installing such parts.

 

The warranty does not cover labor or parts for repairs that we were not able to test for any reason during the repair.

 

What do you have to do?

Bring your device in. We can not determine if your device is eligible for warranty over the phone. You do not need a receipt, or proof of purchase.
